SPANISH PROPERTY LEGAL SUPPORT

Buy in Spain with the legal process covered

From due diligence and contract review to notary completion and post-purchase formalities, Luxton Legal supports overseas buyers through the Spanish property process.

A CLEARER ROUTE THROUGH THE PURCHASE

Know what you are signing before you commit

Buying in Spain involves legal, administrative and tax steps that can feel unfamiliar when you are purchasing from the UK. Before contracts are signed, you need a clear view of the property’s legal position, the paperwork and the obligations attached to the purchase.

Luxton Legal provides conveyancing and property-acquisition support for overseas buyers, including document analysis, contract negotiation, due diligence, coordination with the other parties and completion before a Spanish notary.

Worth knowing

You do not need to be physically present in Spain to complete a property purchase. The process can be handled through a representative using a power of attorney, so it is worth discussing that option early if travel is difficult.

COMMON QUESTIONS

Buying property in Spain: legal FAQs

Do I need to be in Spain to buy a property?

Luxton Legal says physical presence is not necessary. A buyer can be represented through a power of attorney, allowing a representative to act on their behalf during the purchase process.

Will I need an NIE to buy in Spain?

Yes. Luxton Legal identifies the NIE, the foreigner’s identification number, as a required part of the process for a foreign buyer carrying out an economic activity such as purchasing property in Spain.

What can legal due diligence check before I buy?

Luxton Legal’s published guidance lists checks including ownership and title information, outstanding charges or mortgages, planning and building compliance, and obligations connected with the community of owners.

What happens when the purchase completes?

Luxton Legal describes completion as the stage when the purchase deed is signed before a Spanish notary. The wider process can also include settling the applicable taxes, Land Registry formalities, notifications to relevant bodies and arranging changes to utilities.
